The Planning, Housing and Parks (PHP) Committee will meet on Monday, Sept. 14 at 1:30 p.m. to review Subdivision Regulation Amendment (SRA) 26-01, Subdivision of Land – Continuation of Roads, Zoning Text Amendment (ZTA) 26-09, Rural Village Center (RVC) Overlay Zone – Vehicle Repair – Limited Use, and Bill 9-26 – Rental Housing – Maintenance Standards and Essential Services – Air-Conditioning.

The members of the PHP Committee include Chair Andrew Friedson, Council President Natali Fani-González and Councilmember Will Jawando.

Subdivision Regulation Amendment (SRA) 26-01, Subdivision of Land – Continuation of Roads

Review: The PHP Committee will review SRA 26-01, Subdivision of Land – Continuation of Roads, which would prohibit the continuation of roads on certain street classifications if it’s located in a Local Area Transportation Improvement Program area.

The Montgomery County Code requires the continuation of roads in satisfaction of the Road Design and Construction Code. SRA 26-01 would prohibit the Planning Board from approving a subdivision application that connects a neighborhood street or neighborhood yield street within the boundary of a Local Area Transportation Improvement Program with a new development also in the Local Area Transportation Improvement Program area.

The lead sponsor of SRA 26-01 is Councilmember Mink.

Zoning Text Amendment (ZTA) 26-09, Rural Village Center (RVC) Overlay Zone – Vehicle Repair – Limited Use

Review: The PHP Committee will review ZTA 26-09, Rural Village Center (RVC) Overlay Zone – Vehicle Repair – Limited Use, which would allow vehicle repair as limited uses in the RVC Overlay Zone. These uses are currently allowed as conditional uses in the RVC Overlay Zone if the lot has a commercial/residential underlying zone. An underlying zone is the base zoning of the lot, while an overlay zone may place additional requirements.

The limited use standards would mirror the existing standards for major and minor repair, except the setback for major repair would be reduced from 100 feet to 50 feet from the abutting residential lot line for all new buildings. ZTA 26-09 would also make several amendments to apply standards such as setbacks and parking requirements to new parking facilities, not existing buildings or facilities. In addition, the ZTA would allow for alternative structures or designs for tree shading, such as canopies, structural shade, or cool pavements. The ZTA also updates a cross-reference to the Subdivision Ordinance.

The lead sponsor of ZTA 26-09 is Council Vice President Marilyn Balcombe. Councilmembers Dawn Luedtke and Laurie-Anne Sayles are cosponsors of ZTA 26-09.

Bill 9-26 – Rental Housing – Maintenance Standards and Essential Services – Air-Conditioning

Review: The PHP Committee will review Bill 9-26, Rental Housing – Maintenance Standards and Essential Services – Air Conditioning, which would require detached single-family homes offered for rent to meet certain air-conditioning standards and alter the times of year in which air-conditioning requirements apply. In 2020, the Council enacted Bill 24-19, which required landlords to provide air conditioning in rental units during the months of June through September.

Currently, Bill 24-19 exempts detached single-family homes and dwellings located on sites listed in the National Register of Historic Places from the air-conditioning requirement. Bill 9-26 would amend the air conditioning requirements enacted under Bill 24-19 to require the provision of air-conditioning in certain rental properties from May 15 through September 30. In addition, the bill would remove the current exemption for detached single-family homes. Dwellings located on sites listed in the National Register of Historic Places would continue to be exempt. The bill would provide for a transition period, in which landlords of detached single-family homes could seek a temporary waiver from the director of the Department of Housing and Community Affairs.

The lead sponsor of Bill 9-26 is Councilmember Kristin Mink. Councilmembers Sayles and Jawando are cosponsors of Bill 9-26.
