Montgomery County Council Meets on Sept. 29 to Continue Reviewing Long Term Alternatives for the Disposal of Solid Waste – Mocofeed

The Montgomery County Council will meet on Tuesday, Sept. 29 at 9 a.m., and the meeting will begin with two proclamations. The first, presented by Council President Natali Fani-González, will recognize Dolly Parton Day. The second, also presented by the Council President, will recognize Economic Development Week.

The Council will host a Youth Town Hall meeting at 6 p.m. at the Council Office Building.

Review of Long-Term Alternatives for the Disposal of Solid Waste

Review: The Council will continue to discuss long-term solid waste disposal alternatives with representatives of the Department of Environmental Protection (DEP). The possible alternative solid waste disposal options include the continued long-term operation of the County’s Resource Recovery Facility, long-haul to landfill alternatives, and the potential implementation of advanced waste processing.

At this meeting, the Council will receive an overview of operations at the County’s Resource Recovery Facility (RFF). Reworld, the facility operator, will provide a presentation on the RFF’s current and potentially future operations. Additional Council meetings are scheduled for Oct. 13 and Oct. 28 and will include reviews of cost and rate assumptions, environmental and community impacts, and Racial Equity and Social Justice impacts across various options.

The Council received a briefing on the long-term solid waste disposal alternatives at a meeting held on July 28. At a meeting held on Sept. 15, DEP representatives provided an update on the recommendations. The Council received a briefing in July 2025 from DEP representatives about a proposal for the long-hauling of County waste by truck and disposal at an out-of-County landfill. Proposed Closed Session

The Council intends to meet in closed session to meet with counsel to obtain legal advice under Section 3-305(b)(7) of the General Provisions Article of the Maryland Code, and to consult with staff, consultants or other individuals about pending or potential litigation under Section 3-305(b)(8) of the General Provisions Article of the Maryland Code. The topic is legal advice and litigation strategy regarding contractual rights and obligations of the County and regarding the acquisition and use of County facilities.

Unless otherwise noted, the Council will hold the following hybrid public hearings at 1:30 p.m.  Residents can visit the Council website to learn about the multiple ways to provide testimony.

Local Map Amendment (LMA) H-161, 495 Self Storage LLC

Introduction: The Council is expected to introduce Local Map Amendment (LMA) H-161, 495 Self Storage LLC. The applicant requests reclassification from the current IL-1.0, H-50’ Zone to an ILF-2.25, H-50’ Zone. The request is intended to accommodate redevelopment of the self-storage facility.

The Hearing Examiner recommends approval of LMA H-161 with three binding elements. These elements include that uses will be limited to uses allowed in the IL Zone, vehicular access will be limited to a single access point, and the applicant must obtain approval of a parking waiver limited to a maximum of five spaces in connection with site plan approval.

A vote is tentatively scheduled for Oct. 6.

Resolution to approve additions to the Office of Zoning and Administrative Hearings’ Fee Schedule

Vote expected: The Council is expected to vote on a resolution to approve additions to the Office of Zoning and Administrative Hearings’ fee schedule. The Council enacted Zoning Text Amendment (ZTA) 26-08 in July 2026 to amend the Zoning Ordinance to allow for reinstatement of an abandoned nonconforming use under certain conditions which must follow the same process as an application for a conditional use, except that a hearing is only required under certain conditions. The proposed resolution will establish a fee for this use, allowing the processing of these applications. The proposed fee mirrors that for a major amendment of a conditional use, which is 25 percent of the prevailing application fee for a conditional use for such use if one exists. If no such fee exists, then the fee will default to a base of $540 plus $9.60 per square foot.

Resolution to approve revisions to the Process for the Introduction and Consideration of Amendments to the Text of the Zoning Ordinance for the Maryland-Washington Regional District within Montgomery County, Maryland

Vote expected: The Council is expected to vote on a resolution to approve revisions to the process for the introduction and consideration of amendments to the text of the Zoning Ordinance for the Maryland-Washington regional district within Montgomery County. The resolution will update Appendix B of the Zoning Ordinance. The resolution will remove restrictions on public recommendations of ZTAs, clarify what should be included when the County Executive or Planning Board transmit ZTAs, streamline the consultation process for the development of ZTAs, establish a process for the withdrawal of ZTAs, and make technical corrections.

Zoning Text Amendment (ZTA) 26-09, Rural Village Center (RVC) Overlay Zone – Vehicle Repair – Limited Use

Vote expected: The Council is expected to vote on ZTA 26-09, Rural Village Center (RVC) Overlay Zone – Vehicle Repair – Limited Use, which would allow major and minor vehicle repair as limited uses in the RVC Overlay Zone. These uses are currently allowed as conditional uses in the RVC Overlay Zone if the lot has a commercial/residential underlying zone.

The limited use standards would mirror the existing standards for major and minor repair, except the setback for major repair would be reduced from 100 feet to 50 feet from the abutting residential lot line for all new buildings. ZTA 26-09 would also make several amendments to apply standards such as setbacks and parking requirements to new parking facilities, not existing buildings or facilities. In addition, the ZTA would allow for alternative structures or designs for tree shading, such as canopies, structural shade, or cool pavements. The ZTA also updates a cross-reference to the Subdivision Ordinance.

The lead sponsor of ZTA 26-09 is Council Vice President Marilyn Balcombe. Councilmembers Dawn Luedtke and Laurie-Anne Sayles are cosponsors of ZTA 26-09. The Planning, Housing and Parks Committee recommends enactment with amendments including the clarification of setbacks, alternative planting of shade trees and technical amendments.

Sectional Map Amendment (SMA) H-163 – University Boulevard Corridor Plan

Vote expected: The Council is expected to vote on Sectional Map Amendment (SMA) H-163, which is a comprehensive rezoning application to implement the zoning recommendations contained in the approved and adopted 2025 University Boulevard Corridor Plan. SMA H-163 is the same SMA previously advertised as SMA H-161. The District Council approved the 2025 University Boulevard Corridor Plan on Dec. 9, 2025. The master plan sets forth the specific land use and zoning recommendations for the University Boulevard Corridor area and was subject to extensive and detailed review by the District Council.

The SMA application covers a plan area of approximately 905 acres, of which approximately 158 acres are proposed for change in zoning classification including approximately 141 acres under an overlay zone. The remaining 747 acres are proposed to be reconfirmed in their existing zoning classification.
