Public hearing and vote expected: The Council will hold a public hearing and is expected to vote on a resolution to approve the Declaration of No Further Need for the disposition of a portion of the Gude Landfill. The disposition would be completed through a 30-year lease of a 20-acre portion of the Gude Landfill to Community Power Group LLC. The group intends to design, construct, own and operate a five-megawatt solar array facility.

The 162-acre Gude Landfill site is currently owned by the County and is a closed and capped landfill. The landfill received mixed municipal solid waste from 1964 until 1982. The 2019 Gude Landfill Passive Recreational Land Use Master Plan includes passive park amenities and dedicates at least 20 acres for a renewable energy source, which the proposed disposition intends to accomplish.

Expedited Bill 49-26, Administration – Office of the County Executive – Non-merit Positions

Introduction: Lead sponsor Councilmember Will Jawando will introduce Expedited Bill 49-26, Administration – Office of the County Executive – Non-merit Positions, which would increase the number of Assistant Chief Administrative Officers from four to six within the Office of the County Executive. The positions would be created by repurposing two existing positions in the Office of the County Executive. This change is proposed because the County government has grown, and this update would strengthen County government by giving every department clear leadership. The six assistant chief administrative officers would manage a more reasonable portfolio of duties and provide each department with a senior leader.

Councilmembers Shebra Evans, Evan Glass, Sidney Katz and Kristin Mink are cosponsors of Expedited Bill 49-26.

Expedited Bill 50-26, Administration – Non-Merit Appointments – Deputy Directors

Introduction: Lead sponsor Councilmember Jawando will introduce Expedited Bill 50-26, Administration – Non-Merit Appointments – Deputy Directors. Bill 50-26 would convert to non-merit status certain leadership positions within the executive branch of County government, including positions within the Office of the County Attorney, the Department of Finance, Montgomery County Fire and Rescue Services (MCFRS), the Department of General Services (DGS), the Department of Health and Human Services (DHHS), the Office of Human Resources, the Department of Permitting Services (DPS), the Office of Public Information, the Office of Animal Services (OAS), the Office of Community Use of Public Facilities (CUPF), the Office of Human Rights, the Office of Emergency Management and Homeland Security (OEMHS) and the Commission for Women. The purpose of the bill is to make the remaining merit deputy-level positions in the executive branch, four Fire and Rescue Service division chiefs, and the executive directors of certain non-principal offices non-merit positions appointed by the County Executive and confirmed by the Council.

Councilmembers Evans, Glass, Katz and Mink are cosponsors of Expedited Bill 50-26.

Introduction and vote expected: The Council will introduce and is expected to vote on a resolution to extend the time for the transmittal of the Office of Zoning and Administrative Hearings (OZAH) report and recommendations for Local Map Amendment (LMA) H-159, Notley Assemblage LLC, NW quadrant. Under the Zoning Ordinance, the hearing examiner is required to transmit to the District Council a written report and recommendation within 45 days after the closing of the record on any LMA application unless such time is extended. The record for LMA H-159 closed on July 6, 2026. The extension request would extend the time to transmit the report and recommendation for LMA H-159 to Nov. 19, 2026, which is 45 days from the original due date of Oct. 5, 2026.

Local Map Amendment (LMA) H-160, Foundation for Advanced Education in the Sciences (FAES), 9101 Old Georgetown Road, Bethesda, Maryland 20814

Vote expected: The Council is expected to vote on LMA H-160, Foundation for Advanced Education in the Sciences (FAES). The applicant requests that the property located at 9101 Old Georgetown Rd. in Bethesda be classification from its current R-60/TDR-8.0 Zone to a CRTF-1.25, C-1.0, R1.0, H-55’ Zone. The current use is a private club and service organization. The proposed use is a mixed-use development with 18 dwelling units and a clubhouse with a maximum mixed-use density of 66,000 square feet, comprised of nine townhouses, nine multi-family residential dwelling units and a clubhouse with up to 5,000 square feet of community clubhouse and institutional uses.

The Hearing Examiner recommends approval of this local map amendment with five binding elements, including limiting use of the property to a mixed-use residential development with no more than 5,000 square feet of community clubhouse and institutional uses; maintaining minimum building setbacks as shown on the Floating Zone Plan; a maximum building height of 55 feet; and not exceeding 18 total residential units onsite. The Hearing Examiner also indicates that access on West Cedar Lane and Old Georgetown Road remain in a right-in, right-out configuration and that the existing conditional uses and special exceptions on the subject property must be vacated before approval of either the preliminary plan or site plan.

The Council meeting schedule may change from time to time. View the current Council and Committee agendas, Council staff reports and additional information on items scheduled for Council review on the Council website.

Council and committee meetings are streamed live on the Council’s web page via YouTube and on Facebook Live and can be watched on County Cable Montgomery on Xfinity/RCN 6 HD 996/1056, Fios 30, and on the CCM live stream.
