BALTIMORE, MD (August 22, 2025) – In a significant development regarding public safety and accountability, Maryland Attorney General Anthony G. Brown has announced that no charges will be filed against officers involved in a police-involved in-custody death that occurred in Gaithersburg on December 24, 2024. The announcement follows an extensive investigation by the Attorney General’s Independent Investigations Division (IID), which concluded on August 13, 2025.
The incident began when Gaithersburg Police Department (GPD) officers responded to a 911 call reporting a man causing a disturbance in the 300 block of Summit Avenue. Upon arrival, officers encountered Marvin Salamanca Garcia, who was found covered in blood and exhibiting erratic behavior. After exiting the building, Garcia approached the officers while speaking incoherently. In an effort to control the situation, officers restrained him on the ground while awaiting medical assistance.
During this restraint, Garcia lost consciousness and stopped breathing. Despite the immediate medical aid provided by officers until emergency medical services arrived, Garcia was later pronounced deceased at a local hospital on December 26, 2024. The investigation into this tragic event aimed to determine whether the actions of the officers involved constituted a crime under Maryland law.
After a thorough review of the evidence, Attorney General Brown’s office concluded that the officers did not commit any criminal acts. Therefore, the decision has been made not to prosecute any individual officers in connection with this case.
