Montgomery County Council Meets on Oct. 6 to Celebrate Hispanic Heritage Month – Mocofeed

The Montgomery County Council will meet on Tuesday, Oct. 6 at 9 a.m., and the meeting will begin with two proclamations. The first, presented by Councilmember Kate Stewart, will recognize World Mental Health Day. The second, presented by the Councilmembers Shebra Evans, Will Jawando and Kristin Mink, will recognize National Principals Month. At 11:30 a.m., the Council will hold a commemoration celebrating Hispanic Heritage Month.

Bi-Annual Health Update

Briefing: The Council, sitting as the Board of Health, will receive its bi-annual health update from Dr. Kisha Davis, the County health officer in the Department of Health and Human Services (DHHS). The update is expected to include a flu and COVID-19 vaccination update. In addition, the update will include information about Suicide Prevention Awareness Month, National Sickle Cell Awareness Month, Prostate Health Month and Hispanic Heritage Month.

Unless otherwise noted, the Council will hold the following hybrid public hearings at 1:30 p.m.  Residents can visit the Council website to learn about the multiple ways to provide testimony.

  • Bill 40-26, Landlord-Tenant Relations – Accepted Forms of Payment
  • Bill 41-26, Landlord-Tenant Relations – Licensing Procedures and Fees – Accessory Dwelling Unit
  • Bill 42-26, Transient Lodging Facilities – Short-Term Residential Rental – Online Platform Compliance
  • Bill 43-26, Fire Safety – Smoke Escape Hoods in Multifamily Residential Rental Buildings

Local Map Amendment (LMA) H-160, Foundation for Advanced Education in the Sciences (FAES), 9101 Old Georgetown Road, Bethesda, Maryland 20814

Introduction: The Council will introduce Local Map Amendment (LMA) H-160, which is a request by the Foundation for Advanced Education in the Sciences to rezone the property located at 9101 Old Georgetown Rd. in Bethesda. The applicant requests reclassifications of the property from its current R-60/TDR-8.0 Zone to a CRTF-1.25, C-1.0, R1.0, H-55’ Zone. The current use is a private club and service organization. The proposed use is a mixed-use development with 18 dwelling units and a clubhouse with a maximum mixed-use density of 66,000 square feet, comprised of nine townhouses, nine multi-family residential dwelling units, and a clubhouse.

The Hearing Examiner recommends approval of this local map amendment with five binding elements. These include limiting use of the property to a mixed-use residential development with no more than 5,000 square feet of community clubhouse and institutional use and maintaining minimum building setbacks as shown on the Floating Zone Plan, and a maximum building height of 55 feet. In addition, the Hearing Examiner recommends not exceeding 18 total residential units onsite, access on West Cedar Lane and Old Georgetown Road remaining in a right-in, right-out configuration, and that the existing conditional uses and special exceptions on the subject property must be vacated before approval of either the preliminary plan or site plan.

A vote is tentatively scheduled for Oct. 13.

Local Map Amendment (LMA) H-161, 495 Self Storage LLC, 12330 Parklawn Drive, Rockville, Maryland 20852

Vote expected: The Council is expected to vote on LMA H-161, 495 Self Storage LLC. The applicant requests reclassification from the current IL-1.0, H-50’ Zone to an ILF-2.25, H-50’ Zone. The request is intended to accommodate redevelopment of the self-storage facility.

The Hearing Examiner recommends approval of LMA H-161 with three binding elements. These elements include that uses will be limited to uses allowed in the IL Zone, vehicular access will be limited to a single access point, and the applicant must obtain approval of a parking waiver limited to a maximum of five spaces in connection with site plan approval.
